Kazakhstan To Reduce Penalty On A Number Of Administrative Offenses

Kazakhstan may reduce the amount of penalties for more than 150 administrative offenses. Minister of Justice Marat Beketayev announced the news, citing the words of President Nursultan Nazarbayev on the need to humanize the national criminal and administrative law. His words also imply that the Ministry of Justice in cooperation with the interested state bodies, the National Chamber of Entrepreneurs “Atameken” and non-governmental organizations have developed a draft law providing for the introduction of amendments to the Code of Kazakhstan on administrative offenses.


“Administrative fines must be fair and proportionate to the offense committed. The key leitmotif of this draft law is the humanization of the Administrative Offenses Code of the Republic. Under the draft law, the amount of penalties should be reduced for more than 150 various administrative offenses,” Beketayev said during the expanded board meeting of the Ministry of Justice of Kazakhstan.


According to him, the draft law proposes to increase the number of articles providing for sanctions in the form of an administrative penalty as a warning.


“It also envisages the extension of the Institute of reduced production on legal entities and officials, which allows to pay 50 percent of the total amount of the fine within seven days,” the Minister said. He added that the Institute of reduced production is valid only in relation to individuals as of today.


According to Marat Beketayev, the draft law proposes to reduce the amount of an administrative fine by up to 30 percent of the total sum, if there have been revealed extenuating circumstances.
