Kazakhstan Adopts The Law On Prosecutor's Office

The upper chamber of the Kazakh parliament (the Senate) has passed a law on the Prosecutor's Office, which cuts down the grounds for prosecutor's inspections. According to the Prosecutor General, Zhakip Asanov, the tasks and principles of the work of the prosecutor's office remain the same as before: observing the rule of law and protecting the rights of citizens. However, general supervision will not be unlimited now. It will have three forms: verification, analysis and evaluation of legal acts. According to him, there will be no more endless inspections.


According to the prosecutor, the main tool of the prosecutor's office will be the analysis of statistical data and information published by the media. In addition, offenses will be detected using modern IT technologies.


According to Asanov, entrepreneurs will be the first to experience the advantages of the new rule. Now the prosecutor will not have the right to inspect a business on his own initiative; at least a corresponding decision of the Prosecutor General will be necessary for an inspection.


From this moment on, the prosecutor and the state bodies will conduct audits only in two cases: namely, if any state agency violates the rights of persons who are unable to protect themselves, or violates the rights of an unlimited number of persons. The restrictions will also apply to appeals: if an appeal has been received, the prosecutor will not immediately conduct an inspection like it was before.


According to Zh. Asanov, restrictions will be imposed on the duration of an inspection. Now this period will be up to 30 days, and it can be extended by another month only in certain cases.


The new law clearly outlines the powers of the prosecutor, his rights, duties and responsibilities, specifies the tasks of the prosecutor's office, reduces the grounds for appointing prosecutors to inspections, establishes the duties and rights of the entities under audit.
